Do You Own the Rights?

I read a thread here awhile ago discussing copyright infringement when you use a source photo taken by someone other than yourself.

Along a similar vein:

My husband, a writer/author, is planning a future novel that has illustrations. I suggested he search antique stores for photographs that would be appropriate to his needs (circa 1900). Obviously we'd have to seriously check into the legalities of this were he to want artwork derived from these photos (and could easily do so once a publisher is attached to the project), but for now I was wondering if anybody has any idea on whether you own the rights to a photo you bought at an antique store?
